BOOKING CONDITIONS & HOLIDAY FINANCIAL INFORMATION (Terms & Conditions)
All trips/holidays/tours operated by Cycle Morocco are sold subject to the following conditions:
Cycle Morocco is a trading name for one aspect of Bikexplore. Company Registration Number SC689982

1. Terminology

Client; You, the person who has booked and paid for the holiday
Leader; The ride leader nominated by Cycle Morocco
Agent; An operator chosen by Cycle Morocco to operate specific parts of the holiday



2. Financial protection

1.1 . We operate a 100% financial protection policy. Our policies comply fully with the Package Travel and Linked Travel Arrangements Regulations 2018 . This gives the client full financial and legal protection. 
1.2. All moneys paid by the client under this contract, are held in a Travel Trust Account, controlled by an independent trustee acting on your behalf. The funds in this account are not released to Cycle Morocco until your trip/holiday has been completed or, in the event of a cancellation, the contract has been completed in accordance with the booking conditions.  
1.3. This fully complies with UK law, as defined in The Package Travel, Package Holidays and Package Tour Regulations and is for the protection of our customers.
1.4. Full details of our Travel Trust Account and our Trustee can be obtained on request.


3. Our responsibilities to you


3.1 Flights

3.1.1 We do not book any flights and are therefore not regulated by ATOL. We do advise that flights that should be taken in order to arrive at the tour departure point at the correct day and time to start your trip with the rest of the group. We reserve the right to alter tour dates and suggested arrival times as a result of any airline schedule changes.
3.1.2 Flights are provided by an external provider and do not come under the package holiday regulations. Therefore, we accept no liability for any costs incurred by clients for changing dates and times due to flight revisions by airline companies.


3.2 Cancellation by us

3.2.1 Cycle Morocco will endeavour not to cancel your holiday. However, we cannot foresee all circumstances.
3.2.1.1 Force Majeure. Cycle Morocco may have to cancel your trip if it is forced to do so by unusual or unforeseeable circumstances, such as a change in the Foreign Office Advice.
3.2.1.2 Flight cancellations, Cycle Morocco may have to cancel the holiday as a result in changes or cancellations of connecting flights.
3.2.1.3 Minimum number of bookings. Cycle Morocco may have to cancel your holiday if the minimum number of booking have not been reached.
3.2.1.4 Notification. Cycle Morocco will notify you of any changes as soon as they have been made aware.
3.2.1.5 Refunds. If Cycle Morocco has to cancel the tour, we will offer a similar holiday, refund the difference or refund the cost of the holiday. We will not be liable for any expenses incurred by this change.


3.3 Minimum numbers. 

3.3.1 If the minimum number of participants for a Cycle Morocco holiday, as shown on our website, has not been reached by 10 weeks before departure we reserve the right to cancel the tour and/or make significant modifications to the tour. We will offer you alternative dates or a complete refund.


3.4 Other Activities.

3.4.1 Cycle Morocco acts as agent in respect of all activities, whether or not included in the trip price, which          are organised and operated by any other company. Your contract will be directly with the activity provider and subject to their booking conditions.


3.5 Surcharges.

3.5.1 Cycle Morocco will endeavour not to charge surcharges. We will absorb the majority of cost increases. However, Cycle Morocco does reserve the right to apply surcharges up to 6 weeks prior to departure under the following circumstances:
3.5.1.1 Unfavourable exchange rate movements.
3.5.1.2 Increased transport costs.
3.5.1.3 As a result of any government action. 

3.5.2 Charges. you will only be charged the amount if it exceeds 5% of the basic tour cost (we will absorb the rest), and if the charge exceeds 10% of the basic tour cost you may cancel your booking by providing Cycle Morocco written notification within 7 days of us notifying you of the level of the surcharge. This cancellation will be governed by the same alternative tour and refund terms as stated in T & C 2.2 above.


3.6 Changes to the trip itinerary

3.6.1 The trip itinerary is described in the tour prospectus, this is described as accurately as possible and we will endeavour to keep the tour identical to the prospectus. However:
3.6.1.1 Because of the areas in which we operate our trips there may sometimes be changes to the itinerary and it is a fundamental part of your booking conditions that you accept this. You must accept that the written details on the website are there to give you a guide as to what to expect from your trip but there may still be considerable flexibility when on the trip.
3.6.2 You will not be refunded for any differences between the written web material and the actual tour.


3.7 Guides and leaders.

3.7.1 We will provide highly trained ride leaders. They will be trained to a nationally recognised level and have had further in-house training.

3.7.2 All our agents are vetted and experienced.


3.8 Loss or damage

3.8.1 We accept no responsibility for any damage or loss arising from a failure to carry out the contract, or in the process of carrying out the contract, as a result of any actions taken by you, the Client or unusual and unforeseeable circumstances which are beyond the control of Cycle Morocco or any event which even with all due care, could not foresee or changed.

3.8.2 Cycle Morocco is also not responsible for the theft or damage to bicycles or other equipment or injury to you the Client, which occurs as result of cycling on or off-road, or while in transit in any vehicle, or at any other time during the holiday.

3.8.3 Where Cycle Morocco is found to be liable for any damages, these damages will be limited to the price paid for the trip.


3.9 Provision of Information

3.9.1 We provide high quality road books and sometimes GPX files. All routes are researched by us and our agents to give the best possible cycling experience.

3.9.2 Any information provided by Cycle Morocco or its representatives is done so in good faith but without any liability on the part Cycle Morocco or its representatives


3.10 Privacy Policy and General Data Protection Act

3.10.1 Cycle Morocco has a GDPR policy that protects you and your data. If you wish to see a copy, please request this in writing.

3.10.2 This privacy policy sets out how Cycle Morocco uses your data.

3.10.3 Data belongs to you the client, Cycle Morocco’s GDPR policy highlights this.

3.10.4 Cycle Morocco is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website and booking system, then you can be assured that it will only be used in accordance with this privacy statement.

3.10.5 Cycle Morocco may change this policy periodically by updating this page or any forms which are sent to you.

3.10.6 We take personal information security very seriously and are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online and through booking forms sent to us.


3.11 Cookies and how we use them

3.11.1 A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

3.11.2 We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

3.11.3 Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

3.11.4 You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This may prevent you from taking full advantage of the website.


4. Your responsibilities to us


4.1 Flights

4.1.1 It is the Client’s responsibility to arrive at the tour departure point by the start time; or if they do not it is their responsibility to notify us and to join the tour later.


4.2 Booking

4.2.1 To book a place on one of our trips, send a completed booking form with a 10% deposit either by cheque or by bank transfer. Final payment must be made no later than 10 weeks prior to departure. Cycle Morocco reserves the right to cancel your booking should payment be received late.

4.2.2 It is your responsibility to adhere to the conditions of the tour; or notify us in writing of any changes in your circumstances.


4.3 Your contract with us. 

4.3.1 Details of exactly what is and is not included in your contract with Cycle Morocco are shown in the current trip itinerary on the website. You should be familiar with the details before booking.

4.3.2 It is your responsibility to ensure you are able to complete the itinerary. You have a Duty of Care to the tour. The ride leader reserves the right to ask you to use the support vehicle if you are clearly not fit enough to participate.

4.3.3 It is your responsibility to behave in manner expected by the other tour participants and the tour leader, the tour leader reserves the right to remove you from the tour if your behaviour puts the tour at risk.


4.4 Cancellation 

4.4.1.1 Cancellation by you. On receiving written notice of your cancellation, you will be charged the following part of your tour cost, (including single supplements and any additional payments), as a cancellation fee. We have a very straightforward cancellation policy fixed around 10 weeks prior to the departure date.
4.4.1.2 Cancellation before 10 weeks will result in the loss of just your deposit.  
4.4.1.3 Cancellation after 10 weeks will result in the loss of the entire holiday cost.

4.4.2 We understand that sometimes personal situations develop, and our clients have no option other than to withdraw from a trip. We will always do everything we possibly can to transfer you to another trip. In this situation we will use your deposit as an admin charge and ask for another 10% deposit on the new trip.

4.4.3 In some circumstances if our incurred costs are lower than the full cost of the holiday, we will refund you the difference.


4.5 Ride leaders

4.5.1 You must abide by the authority of your local guides and or UK leaders. If they believe that your behaviour presents a risk to the safety of the group, you may be asked to leave the group. You will not be entitled to any refund.


4.6 Holiday Insurance

4.6.1 Before coming on the trip, you must have holiday/medical insurance in place that covers you (and anyone one else who may accompany you) for the activities that you will be taking part in. Insurance company name and policy number details must be supplied with or before final payment along with emergency contact details to Cycle Morocco.

4.6.2 It is your responsibility to abide by any conditions within that insurance policy, including, if required, the wearing of safety equipment.

4.6.3 Cycle Morocco will bear no financial responsibility if the conditions of your insurance are not adhered to.


4.7 Equipment

4.7.1 It is your responsibility to provide all the equipment you need to complete the holiday.

4.7.2 In the case that Cycle Morocco, or its agents, provides a hire bike, you must treat it with care, see hire bike conditions.

4.7.3 Cycle Morocco vets all its agents and hotels. However, we do not take any responsibility for loss of your personal equipment. It is your responsibility to ensure that it is safe.


4.8 Information

4.8.1 You, our Client, remain responsible for finding out any information necessary, such as vaccinations, visa requirements, baggage allowances, etc.

4.8.2 We will require some information from you in order to book you onto the tour:
4.8.2.1 Full name.
4.8.2.2 Contact information including email address and telephone number.
4.8.2.3 Address information such as postcode.
4.8.2.4 Other information relevant to the trip including food intolerances, medical conditions and preferred sleeping arrangements.
4.8.2.5 Insurance details and emergency contact details.


4.9 Valuables

4.9.1 You are solely responsible for your equipment and valuables while you are on a trip with Cycle Morocco. You are solely responsible for the security of the bike you are using; you should not leave bikes unattended and should ensure that they are safely stored and locked to meet your bike insurance policy specifications.

4.9.2 Cycle Morocco accepts no responsibility for losses incurred by the client.


5. Client Consent


5.1 As our Client you hereby consent to taking part in the cycling trip for which you have paid, or any other activities laid on by us. You have read all the website information and understand the fitness and skills level which is required of you to partake in the trip.

5.2 You understand that cycling carries some risks and you are responsible for your own actions whilst cycling. You are responsible for your own safety and you must make a decision to stop and dismount your bike at any point if you feel the terrain or conditions are above your skill or fitness ability (This is not a clause for a refund). 


6. Helmet use


6.1 Cycle Morocco recommends helmet and other equipment, such as cycling gloves, that might make your riding more comfortable or safer. Cycle Morocco recognises that their clients are responsible adults and leaves the final decision to them.


7. Legal obligations


7.1 Cycle Morocco’s Leaders, Tour Managers and its clients must adhere to all legal requirements of the country they are travelling in.

7.2 This might include safety equipment (helmets or hi viz) adoption. Cycle Morocco and its leaders reserve the right to ask a client to leave the tour for persistent disobeying of the country’s rules and regulations.


8. Cultural sensitivity


8.1 Cycle Morocco requires all its clientele to be culturally sensitive in the area we are travelling in.

8.2 Cycle Morocco will provide any necessary information on cultural sensitivities.

8.3 Cycle Morocco reserves the right to ask any client to leave the tour if there is persistent refusal to adhere to cultural sensitivities, or in the Leader’s view causes a slight or offense to the host nation.


9. Complaints procedure.


9.1 Cycle Morocco will endeavour to render your holiday as pleasant and close to the prospectus as possible, see Our obligations to you.

9.2 Cycle Morocco, as part of Bikexplore, adheres to Bikexplore’s Complaint’s Procedure. This can be summarised below:

9.2.1 If you have a complaint about your trip you should communicate directly to the guide, leader or manager so that action can be taken as soon as possible. 
9.2.2 You must also notify Bikexplore of any complaint, in writing, within 14 days of the trip finishing.

9.3 The Bikexplore Complaint’s Procedure is available upon request.
